Notice on the processing of personal data (art. 13 Legislative Decree 196/2003)

Data Subjects: Web site Users.

Piazza Sempione S.p.A. in its capacity of Data Controller of your personal data pursuant to and in accordance with Legislative Decree no. 196, June 30, 2003 (“Code for the Protection of Personal Data”), hereinafter “Privacy Code”, hereby informs you that the above-cited regulation provides for the protection of persons and other parties with regard to the processing of personal data and that such processing shall observe the principles of correctness, lawfulness, transparency and the safeguard of your privacy and your rights.

Your personal data will be processed in accordance with the provisions of the aforementioned regulations and the confidentiality obligations therein.

Purposes for which data is used: in particular your data will be processed for purposes relating to the implementation of the following duties in conformity with legislative or contractual obligations:

* Enrolment in the Piazza Sempione Spa Community;
* Survey on the degree of customer satisfaction.

The processing of data necessary for the fulfilment of these obligations is required for the proper management of the relationship and must be communicated in order to achieve the foregoing purposes. In addition, the Data Controller should notify the data subject that any non-communication or miscommunication of the mandatory information may result in the inability of the Data Controller to ensure consistency in processing.

For processing purposes, the Data Controller may become aware of sensitive data as defined under the Privacy Code, including: Political party membership, trade union membership, philosophical or other beliefs, religious convictions, political opinions, racial or ethnic origins, state of health and sexual orientation. Only your sensitive data directly relevant to the obligations, duties or purposes described above will be subject to processing and will be treated in accordance with the guidelines of the Italian Antitrust Authority.

Subject to your consent, your personal data may also be used for the following purposes:

* To provide information about our possible promotional activities;
* For market and statistical surveys and promotional activities also related to the distribution of advertising and promotional material.

Provision of the data is optional for the above purposes, and your refusal does not affect the continuation of the relationship or processing capacity.

Method of processing: your personal data may be processed in the following ways:

* Processing of data collected by third parties;
* Processing by electronic means.

All processing will be carried out in accordance with the provisions under articles 11, 31 et seq of the Privacy Code and the adoption of minimum security measures provided by the technical specifications (Attachment B).

TYPES OF DATA PROCESSED: Navigation Data
During their normal operation, IT systems and software procedures used to operate the site acquire some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated to specific individuals, but by their very nature could, through processing and association with data held by third parties, enable identification of users.
This category of data includes IP addresses or domain names of computers used by users connecting to the site, URI (Uniform Resource Identifier) of requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the status of the response from the server (successful, error, etc.) and other parameters regarding the operating system and computer environment of the user.
These details are used only to obtain anonymous statistical information about the use of the site and to check its correct functioning and are deleted immediately after processing. The data could be used to ascertain responsibility in cases of hypothetical computer crimes against the site: with the exception of this case, the data on web contacts is held on the site no longer than ten days.
Data provided voluntarily by the User
In order to use the web services the User must register by completing the appropriate form. The data requested on this form is required for registration. Specific notices may be displayed on the pages of the Site designated for special services on request.
COOKIES and WEB BEACONS
Cookies are data that an Internet site sends to the user’s computer when a site is visited. This data can record information that will allow users to navigate in an easier and more effective manner. The Site uses cookies for various purposes, and mainly to capture anonymous data that is non-personal and to provide registered users with the best possible personalized service.

Users use different browsers and different computers. To make access to the Site as simple as possible with any technology the type of browser (i.e., Internet Explorer, Netscape) and operating system (i.e., Windows, Macintosh) used by a user and the domain name of its Internet service provider are recorded automatically. An aggregate total number of visitors to the Site is also recorded; during these procedures no data that will allow personal identification is acquired. This information allows us to monitor which areas of the Site and services are preferred by users, in order to keep the Site updated and interesting.

The cookies technology allows the company to create custom content based on visitors' interests and makes it easier for those ordering products, entering and participating in lotteries and contests, and access to other services offered on our site.
The Site does not use cookies to transmit personal information of the navigators, nor are the so-called persistent cookies used. The Site uses only the so-called session cookies, which are not permanently stored on your computer and are erased when you close your browser, as well as cookies which indicate the version of the site chosen by the user (English or Italian) in order to allow for proper navigation.
If you do not wish to receive cookies, you may set your computer so that there is a warning whenever a cookie is being sent or turn off all cookies through your browser (i.e., Internet Explorer or Netscape Navigator). (Check your browser HELP menu to see how to change or update your cookies.) Where cookies are disabled, you may not be able to access some of our services listed above.

Some of our Web pages and our e-mail updates may contain electronic images called one pixel GIFs, clear GIFs or pixel tags. On Web sites these allow us to count the number of users that have viewed our pages. In promotional messages/newsletters via e-mail they allow us to count how many subscribers have read them. The Web beacons allow us to obtain statistical data about the activities and features that most interest our customers in order to provide more personalized content. They are not used to access personal data without your consent.

Notice: Your data will be stored at our facility and will be communicated only to persons responsible for the performance of services necessary for the proper management of the relationship, ensuring the protection of rights of the party in question.

Your data will be processed only by personnel expressly authorized by the Data Controller and, in particular, by the following categories of appointed parties:

Distribution: Your data may be disclosed with prior consent by means of:

* Publication on the Internet and the User, at the time of registration and subsequently, can freely decide which personal data will be published on the site and made available to all users, even those users who are not registered.

(subject to the absolute prohibition to distribute data disclosing health status, referred to in art. 26, paragraph 5 of Legislative Decree no. 196/2003).

You are entitled to obtain from the Data Controller the removal, communication, updating, modification, integration of personal data concerning you, and generally may exercise all rights provided by art. 7 of the Privacy Code of which a copy is provided below.

Legislative Decree 196/2003: Art. 7 - Right of access to personal data and other rights

1. The data subject shall have the right to obtain confirmation of the existence of personal data concerning him/her, even if not yet recorded and communication of such data in intelligible form.

2. The data subject shall have the right to obtain information regarding:

a) the origin of the personal data;

b) the purposes and methods of its processing;

c) the logic applied in case of processing with the aid of electronic means;

d) the identity of the data controller, data processors and the designated representative under article 5, paragraph 2;

e) the subjects or categories of subjects to whom personal data may be communicated or who may become aware of said data as appointed representative of the State, of data processors or persons in charge of processing.

3. The data subject shall have the right to obtain:

a) the updating, correction or, where interested therein, integration of the data;

b) the cancellation, anonymization or blocking of data processed unlawfully, including data that is not necessary for the purposes for which the data was collected or subsequently processed;
c) the certification that the operations in letters a) and b) have been disclosed, including their contents, to the subjects to which the data was communicated or divulged, unless this requirement proves impossible or involves a use of means clearly disproportionate to the protected right.

4. The data subject shall have the right to object, in whole or in part:

a) on legitimate grounds to the processing of personal data regarding him/her, even if pertinent to the purpose of collection;

b) to the processing of personal data regarding him/her for purposes of sending advertising materials or direct sales or for conducting market or commercial communication research.

Method of acquisition of consent of person concerned

The undersigned data subject, having read the information provided by the data controller in accordance with article 13 of Legislative Decree no. 196/2003 (Disclosure Document N. 7042.1.231170.359156):

Consent to process common data for activities essential for the continuation of the relationship

consents to the processing of personal data for the purposes indicated in the above disclosure document as necessary to permit the Data Controller the correct management of the relationship and adequate data processing.

Consent to processing of sensitive and/or judicial data

aware that processing may include some data defined sensitive or judicial as referred to in art. 4 paragraph 1 letters d) and e) and art. 26 of Legislative Decree 196/2003, and in particular: Political party membership, trade union membership, philosophical or other beliefs, religious convictions, political opinions, racial or ethnic origins, state of health and sexual orientation,

freely consents to the processing of his/her sensitive personal data as results from the above disclosure document, limited however to compliance with any condition imposed by law.

Consent to further processing, not essential for the continuation of the relationship.
